Texas Underage Drinking & Driving Lawyer
Driving Under the Influence and Under-21 DWI
Drivers who are under the legal drinking age do not get “kid glove” treatment for drinking and driving. In fact, they are held to a lower threshold and face severe sanctions for any alcohol in their system if they are pulled over by police.
If you are under 21 and suspected of drunk driving, or if your minor child has been charged with driving under the influence, a skilled defense is required to try to avoid the conviction, license suspension and other consequences. (DUI is often issued as a citation rather than taking the driver into custody, but this is not a simple traffic ticket!)
The drunk driving defense lawyers of Tad Nelson & Associates have represented many underage drivers in Houston, Harris County, Galveston County and surrounding counties of Texas. Call our League City office at 281-280-0100
Texas Underage Drinking and Driving Attorney
A minor (any driver under age 21) is subject to Texas’ Zero Tolerance law. Minors can be charged with driving under the influence (DUI) for any detectable amount of alcohol — one swig of beer is all it takes.
DUI is a class C misdemeanor punishable by fines, community service and 90-day license suspension, plus the criminal record. Subsequent offenses can result in jail time, higher fines and longer suspension of driving privileges.
Minors may be eligible for deferred adjudication to keep the DUI off their record if they stay out of trouble and comply with the court’s terms. However, underage drivers can only get one deferment and a deferred adjudication still counts as a DUI conviction for purposes of future arrests.
Drivers who are over 18 but under 21 and found to have a blood-alcohol content (BAC) of .08 or greater are subject to the full adult penalties for driving while intoxicated (DWI).
Tad Nelson and his team will explore every avenue to get the charges dismissed or to have the case deferred to prevent this episode from ruining a young person’s future. Depending on the jurisdiction, we are also prepared to negotiate a plea to a non-DUI offense or fight the DUI/DWI at trial.
